Office of the Property Rights Ombudsman Reviewed County Land Use Ordinance and Permitting.

The Utah Office of the Property Rights Ombudsman issued an advisory opinion on August 2, 2023. Park City School District requested the review of state and county land use laws pertaining to school building renovation July 2022. 

 

Park City School District sought clarification from the Ombudsman in order to inform future school renovation and construction projects.

 

While the Ombud’s report acknowledges that Summit County’s requirement to obtain a Conditional Use Permit (CUP) is appropriate, it also recognizes that the County must adhere to high standards, thereby limiting its regulation of local board authority in school building renovations. The County’s authority is limited to what is specifically provided for in statute or when “necessary to avoid unreasonable risks to health or safety.”  

 

Park City School District has completed all necessary permitting for its current projects, and work is anticipated to be completed for the 25/26 school year. PCSD continues to collaborate with Summit County to ensure all school site projects meet safety requirements without unnecessary hindrances or delays. Our commitment to maintaining a safe environment for our students and staff remains unwavering.
